The purpose of mobile Recreational Fishery Catch System application (hereinafter – the Mobile App) is to collect and systematise reliable data on recreational fishing trips to the Baltic Sea, the number of recreational fishers in the Baltic Sea, and data on their catch.

The Fisheries Service under the Ministry of Agriculture of the Republic of Lithuania (hereinafter – the Fisheries Service), seeking to ensure the safety of personal data processing under Articles 13 and 14 of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ L 119, 2016, p. 1) (hereinafter – GDPR), provisions of the Law on Legal Protection of Personal Data of the Republic of Lithuania, and Order No. V1-33 ‘Regarding the implementation of the General Data Protection Regulation’, issued by the Director of the Fisheries Service on 17 January 2020, hereby informs the personal data subject (natural or legal entity, a legal representative of a natural or a legal entity) of the following:

Personal data processed:

• name, surname, personal code, phone number, e-mail address of a natural person (to identify the person, accessing the Mobile App);
• name, surname, personal code, phone number, e-mail address of a legal representative of a natural person, and the basis of representation (e.g. power of attorney, etc.);
• information, indicated in the registration certificate of a legal entity (to identify the person, accessing the Mobile App);
• name, surname, position of the representative of the legal entity, and basis of representation (e.g. power of attorney, procuration, etc.).

Purposes of personal data processing. The above-mentioned personal data is processed for the following purposes:

• the data processing is necessary for the Fisheries Service to be able to fulfil its legal obligations (GDPR Art. 6(1)(c));
• in pursuit of the legitimate interests of the Fisheries Service (GDPR Art 6(1)(f));
• the data processing is necessary in order to assert, exercise or defend legal claims or in the event, when courts exercise their judicial powers (GDPR Art 9(2)(f));

Providing personal data to third parties. Personal data is provided to third parties in cases where such an obligation is established by legal acts, for example upon receipt of a legal request by state or municipal authorities, in order to prevent criminal acts, etc.

Organisational and technical data safety measures. The Fisheries Service can hire data processors for personal data processing. In such cases, the necessary measures must be taken to ensure that personal data processors process personal data in compliance with the requirements of the legislation in force.

The Fisheries Service, seeking to protect personal data, implements and ensures proper organisational and technical measures used to protect personal data from accidental or unlawful destruction, alteration, disclosure, and also from any other illegal processing. It also ensures security, management and control of access to personal data.

Personal data is stored at the Fisheries Services no longer than required by the purposes of data processing, the law, and other legislation, and only to the extent the personal data must be stored for document archiving purposes in accordance with the terms and procedures, established by the law.

Rights of data subject:

• To know (to be informed) about the processing of their (or the person’s they are representing) personal data;
• To have an access to their (or the person's they are representing) personal data;
• To demand to rectify inaccurate personal data;
• To demand to erase the personal data (‘the right to be forgotten’);
• To restrict (stop) personal data processing under at least one of the following conditions:
  • The personal data subject disputes the accuracy of personal data – for the period during which the Fisheries Service will verify the accuracy of personal data;
  • Personal data processing is illegal and the personal data subject does not agree with erasing of the data, thus asking to restrict its use;
  • Personal data subject objects to personal data processing – for the period, required to reaffirm if the legal interest of the Fisheries Service is more important than the rights of the personal data subject;
  • The Fisheries Service no longer requires the personal data, but the personal data subject demands for it in order to assert, exercise or defend their legal claims.
• Disagree with personal data processing. In this case, the personal data subject automatically waives claims regarding the quality of services provided by the Fisheries Service, as the requested personal data is necessary for proper provision of the services requested by the personal data subject.

According to clause 54 of the Rules for Personal Data Processing and the Implementation of the Rights of the Personal Data Subject in the Fisheries Service under the Ministry of Agriculture of the Republic of Lithuania, adopted by the Order No. V1-33 ‘Regarding the implementation of the General Data Protection Regulation’, issued by the Director of the Fisheries Service on 17 January 2020, ‘Upon receiving a request of a data subject, they must be provided with information on the actions taken based on their request no later than in one month since the request has been submitted’.
